Nipendo Ltd. (“Nipendo”), an affiliate of American Express Company, is committed to protecting your privacy. This privacy policy (“Privacy Policy”) provides information about how Nipendo processes your data when you engage in the following activities: (i) browse and visit www.nipendo.com or other webpages operated by us (“Website(s)”); (ii) use our cloud management platform via our web application or mobile application (“App”) as a customer (“Customer”); or (iii) act as a supplier with whom the Customer conducts business (“Supplier”).
This Privacy Policy may be updated when necessary. When we update our Privacy Policy, we will take appropriate measures to inform you, consistent with the nature of the changes we make. Any changes to this Privacy Policy will become effective as of the “Effective Date” at the top of this page. When you continue to use our services following an update, your continued use will constitute acceptance of the updated Privacy Policy.
1) INFORMATION WE COLLECT
Depending on your interaction with us, we may collect the following categories of data from you:
- Non Personal Data: This is information which may be collected through your use of our services and cannot be linked to your identity (“Non-Personal Data”). Non-Personal Data may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information about your device (for example, the device you use, the type of browser and operating system your device uses, and access time);
- Personal Data: This information can be linked to an identifiable individual or may, with reasonable effort, identify an individual (“Personal Data”). We may also collect information about your communications with us or with other Nipendo users as well as feedback, suggestions, complaints and reports you send to us.
If we combine Personal Data with Non-Personal Data, the combined data will be treated as Personal Data for as long as it remains combined. Please note that you do not have any legal obligation to provide us with your Personal Data. Any Personal Data that you have provided has been provided with your own free will and consent.

Legal Requirement – We may disclose Personal Data to comply with our legal or regulatory obligations, including law enforcement authorities or court orders directing us to disclose Personal Data of any Nipendo user suspected to have engaged in illegal or infringing behavior.
Corporate Transaction – We may share Personal Data in the event of a corporate transaction (e.g., sale of a substantial part of our business, merger, consolidation or asset sale). In the event of the above, our affiliated companies or acquiring company will assume the rights and obligations as described in this Privacy Policy.
Affiliates – We may share Personal Data with our affiliates, including our parent company American Express Company.
5) DATA RETENTION
We reserve the right to retain Personal Data for as long as reasonably necessary to: (i) provide the services described herein; (ii) defend or assert legal claims and liability; and/or (iii) comply with applicable laws. Retention periods are determined based on the type of information that is collected and the purpose for which it is collected and in light of our legal and compliance obligations to retain information for litigation or regulatory investigations. We comply with requirements to destroy information when it is no longer necessary to fulfill the purposes for which it was collected.

Individuals have certain rights regarding their Personal Data, including the right to know how we process Personal Data, the right to access Personal Data, and the right to request rectification and deletion of certain Personal Data.
