We have included below information about which data is processed, how we process and use your data, but before, we would like to explain the lawful basis for which we do so:
(i) Where a Customer or Customer’s Supplier register to any of our services or App, we process certain Personal Data, such as name and email, in order to perform our contract;
(ii) When you access our Website, we collect certain Online Identifiers which we have a legitimate interest or consent in processing such data, some of this data is processed by our third party partners, all as detailed below; or
(iii) We will also process certain Personal Data where you have provided us with consent to do so, if and when applicable.
2) INFORMATION WE COLLECT
Depending on your interaction with us (meaning, if you are a visitor, Customer or Customer’s Supplier), we may collect two types of data from you:
- Non Personal Data: this data is non-identifiable information which may be made available or gathered through your use of the Services. To clarify, we are not aware of your identity due to such information (“Non-Personal Data”).
- Personal Data: individually identifiable information, namely information that identifies an individual or may with reasonable effort identify an individual (“Personal Data”).
In addition, if we combine Personal Data with Non-Personal Data, the combined data will be treated as Personal Data for as long as it remains combined.

|During your use of the App or Website, we process Non-Personal, technical and aggregated data about you. This data includes, without limitations: the type of device, browser and operating systems, the time and date you enter and use the Website or App, your navigation within the Website or App and your approximate location (i.e., country).||We use this technical data in order to operate and manage our Website, App and applicable services therein.|
|When you access the Website or the App, we collect your IP, cookies, agents and mobile device identifiers, when applicable (“Online Identifiers”). Note that we treat the Online Identifiers as Personal Data.||We either directly or indirectly may collect our visitors’ IP. We use this for (i) operating, providing, maintaining, protecting, managing, customizing and improving the Website, App and services; or (ii) enhancing the services, look and feel of the App.|
|In the event you contact us for support or other inquiries, either through an online form available in the Website or other webpages we operate (including promotions), or by sending us an email, you will be requested to provide us with contact information including your name, phone number, email address, title, etc.||We will use this information solely for the purpose of responding to your inquiries and provide you with the support or information you have requested.|
|If you want to download a whitepaper, webinar, case study, etc. offered through the Website, you will be asked to provide us with some contact information including name, phone number, email address, your company, job title and country of residence.||We will use this information to send you the requested content, as well as updates, tips and services you may be interested in the future. If you wish to stop receiving such content you may unsubscribe at any time or contact us to assist you.|
|To comment on our blog posts, you will be asked to provide us with your name and email address.||We will use this data solely to enable you to publish your comment.|
|As a Customer, during your registration, we collet your contact information (e.g., name, email, phone number, etc.), as well as the authorized personnel name and email address that you choose to add as a user of the Nipendo App.||We use this data to preform our contract with you and solely to provide the service.|
|As a Customer, during the registration, we will collect the contact information (name, email, phone number, etc.) of your Suppliers. We may also collect Customer’s Suppliers additional information, as will be required while Customer’s Suppliers will register to the services.||We will use this data solely to perform our contract with you and provide the service.|
3) HOW WE COLLECT INFORMATION
Depending on the nature of your interaction with the Services, we may collect information as follows:
- Provided by you voluntarily – we will collect information if and when you choose to provide us with the information, such as through a registration process, contact us communications, to receive a whitepaper, etc.
5) SHARING DATA
We share Personal Data only under the following limited circumstances:
Third party service providers– We share your information with trusted partners and third parties who assist us in operating and providing the services and conducting our business, such as our servers, account maintenance, technology services, marketing partners to provide you with service offers you may be interested in, etc.
Law Requirement– We will fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity, behavior or digital content of any user suspected to have engaged in illegal or infringing behavior and thereby we may also release your information when we believe release is appropriate to comply with the law.
Policy Enforcement– We will share your information, solely to the extent needed to enforce our policies including investigations of potential violations thereof or to detect, prevent, or take action regarding illegal activities or other wrongdoing, suspected fraud or security issues.
Company’s Rights– We will share your information, solely to the extent needed to establish or exercise our rights to defend against legal claims;
Third Party Rights– We will share your information, solely to the extent needed to prevent harm to the rights, property or safety of us, our users, yourself or any third party or for the purpose of collaborating with law enforcement agencies or in case we find it necessary in order to enforce intellectual property or other legal rights; or
6) DATA RETENTION
We reserve the right to retain any Personal Data for as long as reasonably necessary in order to: (i) fulfill all the services described herein; (ii) defense or assertion of legal claims and liability; and (iii) comply with applicable law.

Individuals have the right to know what Personal Data we process about them and to control our use, for more information, please review our Data Subject Rights Policy available at: www.nipendo.com/userights.
We provide you with the ability to exercise certain choices and controls in connection with our treatment of your Personal Data, depending on your relationship with us. If you wish to exercise any or all of the above rights, please fill out the DSR Form available here and email it to: [email protected].
Where we are not able to comply with your request, we will endeavor to explain the reasoning for this and inform you of your rights, including the right to complain to the supervisor authority.
Data privacy and related laws in your jurisdiction may provide you with different or additional rights related to the data we collect from you, which may also apply.
8) HOW WE PROTECT INFORMATION
We take great care in implementing and maintaining the security of the Website, App or service and your Personal Data. We employ industry standard procedures and policies and implemented technical and administrative security measures to ensure the safety of your Personal Data and prevent unauthorized access or use of any such information. We adopted technical organizational security measures as detailed here: www.nipendo.com/security. The Security Policy also discloses our practice when transferring data, however, please note that if you are a resident of the EEA we will take appropriate measures to ensure that your Personal Data receives an adequate level of data protection upon its transfer outside of the EEA or, if you are a resident of a jurisdiction where transfer of your personal data requires your consent, by using the Nipendo App or Website you provide us with consent for such transfer of your data.
9) USE OF WEBSITE BY MINORS
Our services are not direct or intended for children or any person under the age of 18.
